Great News! The NY LHCSA Applications are now open, however based on public need, and specific requirements. The process is now vigorous and will significantly limit the ability to start a new agency in NY. It is based on public need methodology. We emphasize that not everyone should apply. Prior to the moratorium the process was long and complicated however, was not as selective as the new requirements. We encourage our clients and prospective clients to evaluate the requirements realistically before deciding to apply. The choice to apply should be strategically and carefully considered. Emmanuel Consulting Agency Inc will be providing consultations to discuss the new requirements so that you can make an informed decision before starting. Please be advised that since we have clients on our waiting list for this service, we will not be able to answer calls regarding this matter as we expect to receive a high volume in calls. Change of Ownership Applications
Applications for licensure based on change of ownership for LHCSAs actively serving at least 25 patients will not be subject to public need review and other requirements “unless the proposed operator seeks to serve patients outside of the agency’s approved counties”.
Assisted Living Program, Nurse Family Partnership, PACE Program
“Will be exempt from the public need methodology if the agency exclusively serves patients within those programs. The agency will be subject to the need methodology if they apply to serve patients outside of the specific program”.
